Abstract


The 1945 Constitution of the Republic of Indonesia (UUD 1945) does not explicitly define “election result disputes.” This definition is only found in several laws and Constitutional Court (MK) Regulations, limited to the context of “vote counting errors.” This research aims to reformulate the concept of election results as an object of dispute in the MK to ensure certainty and justice for candidates and/or candidate pairs. This study uses a normative juridical research method. Elections, as an embodiment of the people’s sovereignty, result in the acquisition of votes and the determination of elected candidates and/or candidate pairs to occupy political positions in government. The resolution of election result disputes in the MK relates to objections to the validity of the vote count, both quantitatively and qualitatively. The examination of the validity of vote acquisition maps the MK’s authority into two scopes: absolute competence and relative competence. The MK’s absolute competence relates to resolving disputes over vote acquisition, while relative competence pertains to ensuring constitutionality, including adherence to election regulations by election organizers during the election stages.

Firdaus Firdaus, Faculty of Law, Sultan Ageng Tirtayasa University, Serang, Banten, Indonesia

Firdaus, was born in Sinjai on September 13, 1975. Elementary school education up to high school was completed in South Sinjai. In 2001 he earned a Bachelor of Laws, Concentration of Constitutional Law at the Faculty of Law, Tadulako University, Palu. Master of Law was achieved in 2006 at the Postgraduate Program of Padjajaran University Bandung and completed the Doctor of Law Program, concentration on Constitutional Law at the Postgraduate Program of Padjajaran University Bandung in 2012. Visiting Research at the Department of Political Science at Ohio State University in 2010. Since 2006 until now, he has been active as a lecturer of Constitutional Law in the S1 and S2 programs of the Faculty of Law, Sultan Ageng Tirtayasa University, Banten. Being an Expert in several state institutions, including the Expert Group of DPD RI, the MPR RI Study Board, and the Honorary Board of Election Organizers. Several written works both books and scientific articles published in journals of national and international repute.

Nalom Kurniawan, Constitutional Court of the Republic of Indonesia, Jakarta, Indonesia

Nalom Kurniawan is a Researcher and Expert Assistant Judge at the Indonesian Constitutional Court. His Bachelor of Laws was obtained at the Faculty of Law, Widyagama University Malang, in 1997. Master of Laws obtained at the Postgraduate Program (S2) Padjadjaran University Bandung, 2002 and Doctoral in Law Science achieved at the Doctoral Program of Brawijaya University Malang in 2013. He participated in several informal education including Legislative Drafting, Oxford University cooperation with Padjarjaran University, 2003 and Advance Short Course in Human Rights, Cooperation with Roul Wallenberg Intitute & Swedish Development Agency (SIDA), 2004. In addition to active teaching, several scientific works both in the form of books and journal articles have been published in reputable journals.

Muhammad Uut Lutfi, Faculty of Law, Sultan Ageng Tirtayasa University, Serang, Banten, Indonesia

Muhamad Uut Lutfi is a lecturer and researcher in Constitutional Law, Faculty of Law, Sultan Ageng Tirtayasa University. He is the Chairperson of the Task Force for the Prevention and Handling of Sexual Violence at the Sultan Ageng Tirtayasa University, Advisor at the UNTIRTA Faculty of Law Ambassador.  He is also an activist for Child Protection in Banten Province, and Chairperson of the Task Force Forum for the Prevention and Handling of Sexual Violence in Higher Education in Banten. He has also been a speaker at various academic forums both regionally and nationally. He was also the Head of the Faculty of Law Laboratory at Sultan Ageng Tirtayasa University.

Belardo Prasteya Mega Jaya, Faculty of Law, Sultan Ageng Tirtayasa University, Serang, Banten, Indonesia

Belardo Prasetya Mega Jaya, is a lecturer and researcher in International Law, Faculty of Law, Sultan Ageng Tirtayasa University. He is a member of the Indonesian Society of International Law Lecturers (ISILL). He is the head of International Services at the Faculty of Law, Sultan Ageng Tirtayasa University, coordinator of Quality Assurance and learning development, internal auditor, senior researcher at the Center for International Law Studies, senior researcher at the Untirta Center for Marine and Coastal Studies, editor-in-chief of Tirtayasa Journal of International Law, Untirta International Accreditation team. He is also a reviewer in many national and international Scopus (Q1) journals.
