Constitutional Interpretation of the Right to Judicial Power within the Rule of Law Framework

The Constitutional Court has never clearly articulated the interpretation of judicial power as a constitutional right of citizens; consequently, citizens encounter difficulties in holding judicial institutions accountable through judicial review proceedings. This study employs normative legal research with explanatory methods, relying on secondary data that includes primary, secondary, and tertiary legal materials. The author organised and analysed the data using a qualitative method. This research demonstrates that all four constitutions that have historically been enforced in Indonesia regulate the independence of the judiciary— notably, the 1949 RIS Constitution and the 1950 UUDS regulated judicial independence as a straightforward constitutional right. In contrast, the framers of the current Constitution introduced judicial independence in Article 24(1) merely as a function, serving as a general statement on control mechanisms and the separation of powers principle. Therefore, the author concludes that not all articles regulating institutions confer constitutional authority, a conclusion grounded in internal and external control mechanisms. Finally, this study employs a historical and contextual approach to interpret the right to an independent judiciary as an implied and unenumerated right.
