Disregarding the Constitutional Court Decision Concerning the Prohibition of Concurrent Deputy Minister Positions

Abstract


The presence of the deputy minister position in the Indonesian government system has been a constitutional issue, both in its appointment and the issue of the prohibition of holding multiple positions. This article discusses Constitutional Court Decision Number 80/PUU-XVII/2019, which provides clarity on the constitutionality of the appointment of deputy ministers and the prohibition of holding multiple positions, including as commissioners or directors in state-owned or private companies. Despite this decision, the analysis indicates that the prohibition of holding multiple positions for deputy ministers is still disregarded, as some deputy ministers currently serve as Commissioners in State-Owned Enterprises (SOEs). This research uses a normative approach by analyzing secondary data. The result is that the Constitution is ignored because the Constitutional Court Decision regarding the prohibition of holding multiple positions for deputy ministers is not implemented. To address this non-compliance, if deputy ministers continue to hold positions as commissioners, the President should be able to dismiss them based on the State Ministry Law and Constitutional Court Decision, and impose sanctions in the form of an obligation to compensate the state’s financial loss incurred during the concurrent positions.

Sonia Sekar Sari was born on April 13, 2000, in Pammase. She completed her primary and higher education at SD Inp 6/75 Selli, SMPN 1 Lappariaja, and SMAN 5 Bone. In 2022, Sonia finished her studies in Law at the Faculty of Law, Hasanuddin University, Makassar. Currently, she is pursuing her postgraduate degree at the same university. Aminuddin Ilmar, Faculty of Law, Hasanuddin University, Makassar, Indonesia

Aminuddin Ilmar is a Professor of Constitutional Law at the Faculty of Law, Hasanuddin University in Makassar. He completed his Bachelor of Laws degree at the same university in 1988. He also holds a Master of Law degree (Strata Dua or S.2) from Airlangga University in Surabaya, which he completed in 1995, and a Doctor of Law degree (Strata Tiga or S.3) from Airlangga University, which he completed in 1999. Currently, he is working as a lecturer at the Faculty of Law, Hasanuddin University in Makassar, and has been a speaker and resource person at various seminars and meetings since 2012. Along with his teaching and speaking activities, he has been writing scientific books and journals since 2009.

Eka Merdekawati Djafar, Faculty of Law, Hasanuddin University, Makassar, Indonesia

Eka Merdekawati Djafar was born on May 13, 1982, in Ujung Pandang. Currently, Eka serves as a lecturer at the Department of Constitutional Law, Faculty of Law, Hasanuddin University, Makassar. Eka completed the study of Law/State Administration Law at the Hasanuddin University Undergraduate program, Makassar, in 2004, and continued formal education at the Hasanuddin University Postgraduate program, Makassar, which was completed in 2009. In addition to being an active lecturer, Eka is also involved in writing for print and digital media.

Pan Mohamad Faiz, Centre for Research and Case Studies, and Library Management, Constitutional Court of the Republic of Indonesia, Jakarta, Indonesia

Pan Mohammad Faiz is the Head of the Centre for Research, Case Studies, and Library Management (Puslitka) at the Indonesian Constitutional Court. He holds a Bachelor of Laws (S.H.) from the University of Indonesia, a Master of Comparative Laws (M.C.L.) from the University of Delhi, and a Doctor of Philosophy (Ph.D.) from TC Beirne School of Law, University of Queensland, Australia. He is a Lecturer at the Faculty of Law, Universitas Brawijaya, and other universities, and an External Research Fellow at the Centre for Public, International, and Comparative Law (CPICL), University of Queensland, Australia. Faiz has published several scientific papers in law and constitution, including opinion articles, books, and journals at both national and international levels (Scopus). His latest book, titled "Court and Diversity: The Twenty Years of the Indonesian Constitutional Court, " will be published in April 2024 by Brill Publishers in Leiden.
