Abstract


Until now, the institutional dualism of election monitoring institutions and regional elections in Aceh still exists. This condition still leaves problems in the implementation of election supervision and regional elections in Aceh. This article focuses discussion on aspects of legal policy choices that can be taken to resolve this dualism. This research is normative legal research which fully uses secondary data in the form of primary and secondary legal materials. This study concludes that the root of the problem of dualism in the election and regional election supervisory institutions in Aceh is due to the lack of synchronization in the regulation of the Election Law and the Regional Election Law with the Aceh Government Law. This was also reinforced by the Constitutional Court's decision which stated that Article 557 and Article 571 letter d of the Election Law were contrary to the UUD 1945 because their formation was not in accordance with the provisions of the amendment to the Aceh Government Law contained in the Aceh Government Law itself. This research recommends that the institutional dualism of election and regional election supervisory institutions in Aceh be ended immediately by making changes to the Election Law, Regional Election Law and Aceh Government Law.

Author Biographies

Khairul Fahmi, Faculty of Law, Andalas University, Padang, West Sumatra, Indonesia

Khairul Fahmi was born in Canduang, a Nagari at the foot of Mount Marapi, Agam Regency. He has been serving as a Lecturer in Constitutional Law at the Faculty of Law, Universitas Andalas since the end of 2010. He received his elementary and secondary education at Madrasah Ibtidaiyah Negeri, Pondok Pesantren Ashabul Yamin, and Madrasah Tarbiyah Islamiyah Canduang. He completed his S-1 and S-2 degrees in Law at the Faculty of Law, Universitas Andalas, and his Doctoral degree in Law at the Doctoral Program in Law, Faculty of Law, Universitas Gadjah Mada in 2019. Before serving as an academic, he worked as a public advocate and served as Chair of the Regional Board of the Indonesian Legal Aid and Human Rights Association (PBHI) West Sumatra (2008-2011). To date, he has actively published works in the form of books and articles in various reputable national and international journals, while also contributing his thoughts on contemporary legal issues in various electronic media and local and national print media.

Ilhamdi Putra, Faculty of Law, Andalas University, Padang, West Sumatra, Indonesia

Ilhamdi Putra was born in Padang, West Sumatra. He pursued higher education at the Faculty of Law, Bung Hatta University (2012-2016), and the Graduate Program at the Faculty of Law, Andalas University (2018-2021). Prior to serving as a lecturer in the Department of Constitutional Law at the Faculty of Law, Andalas University, starting in 2022, he worked as a visiting researcher at the Bung Hatta Anticorruption Studies Center (BHAKTI), a researcher in the literature and humanities research room at Lab. Pauh9, and a freelance writer for several media outlets such as Padang Ekspres, Koran Haluan, Koran Singgalang, Media Indonesia, Koran Tempo, Jawa Pos, Garak.id, Marewai.id, and others. In 2019, he was selected as one of the Indonesian Emerging Writers of 2019 at the Ubud Writers and Readers Festival in Ubud, Bali. He actively publishes his writings addressing legal, political, cultural, and literary issues in various electronic media, alternative media, as well as local and national print media.

Beni Kharisma Arrasuli, Faculty of Law, Andalas University, Padang, West Sumatra, Indonesia

Beni Kharisma Arrasuli was born in Padang on March 31, 1983. He completed his elementary education at SD Negeri 03, Cengkareng Timur, West Jakarta (1994), and continued his education at Islamic boarding schools, completing his studies at Mts and MA in Pondok Pesantren Madrasah Tarbiyah Islamiyah Canduang, Agam Regency, West Sumatra. In 2002, he pursued studies at the Faculty of Sharia and Law, UIN Yogyakarta, majoring in Jinayah Siyasah (Islamic Criminal and Political Law). In 2009, he continued his postgraduate education in Master of Law (Constitutional Law Cluster) at Gadjah Mada University, Yogyakarta. In 2007, he joined as a Field Officer at the German-affiliated NGO, Arbeiter Samariter Bund, and in 2008 became a Facilitator at the Disaster Prevention Research Institute (DPRI), Kyoto University. He volunteered for the West Sumatra Earthquake in 2009 as a Provincial Volunteer for the Special Region of Yogyakarta. Since 2015, he has been serving as a lecturer in Constitutional Law at the Faculty of Law, Andalas University.
