Penguatan Partisipasi Rakyat dalam Proses Perubahan Konstitusi di Indonesia

Abstract


The rules governing constitutional amendment in Indonesia still leave one crucial issue unresolved: the absence of regulations on mechanisms for public participation. Although previous studies have attempted to address this issue, the proposed ideas have not yet covered public participation at every stage of the amendment process. This article seeks to fill that literature gap by proposing mechanisms for public participation at each stage of the constitutional amendment. This doctrinal study employs comparative, statutory, and conceptual approaches. The findings lead to two conclusions. First, countries such as Chile, Ireland, and Romania have clear rules on public participation that positively affect constitutional amendment processes, making them suitable references for Indonesia. Second, Indonesia can strengthen public participation by adopting constitutional initiative mechanisms at the proposal stage, establishing a constitutional convention at the deliberation stage, and holding a referendum at the ratification stage.
