Constitutionality of the Regional-Owned Enterprises in the Management of New and Renewable Energy

Abstract


This research focuses on the constitutionality of the Regional-Owned Enterprises authority in the management of New and Renewable Energy. There are two research objectives to be obtained. First, the classification of EBT in the major production branches and the dominance over people’s lives refers to the dynamics of laws and decisions of the Constitutional Court. Second, the determination of BUMD's authority over the management of EBT refers to the state's control rights according to MK. This research is normative legal research based on secondary data. This research showed two conclusions. First, the classification of EBT includes nuclear, coal methane gas, liquefied and gasified coal, geothermal, and water flows and waterfalls. Second, the position of BUMD is classified into two models; (1) BUMN is prioritized over BUMD; and (2) BUMD is equivalent to BUMN. However, for SDA which are not included in this qualification, the position of these entities are equal.

Nivia Nivia, Faculty of Law, Gadjah Mada University, Yogyakarta, Indonesia

Nivia, was born in Pangkalpinang, August 6, 2002. Recently, the Author is an independent researcher and a research assistent for lecturer. Besides, she is also a trainee in PT Bank Rakyat Indonesia (Persero), Tbk. management trainee program. Her research focuses are intenational law, international criminal law, Critical Legal Studies, international environmental law, Critical Criminology, and human rights law.

Garuda Era Ruhpinesthi, Faculty of Law, Gadjah Mada University, Yogyakarta, Indonesia

Garuda Era Ruhpinesthi, was born in Yogyakarta City, November 1, 2001. Currently, the Author is active as a Research Assistant for the Swasaba Research Initiative and a Researcher at the Democracy, Constitution, and Human Rights Research Centre, Faculty of Law, UGM. The Author's research focus is related to constitutional law issues such as legislation, political parties and general elections, regional government, and human rights.

Alfatania Sekar Ismaya , Faculty of Law, Gadjah Mada University, Yogyakarta, Indonesia

Alfatania Sekar Ismaya was born in Gresik, November 3, 2001. Currently, the Author is active as a Research Assistant for the Swasaba Research Initiative and a Researcher at Centre of Law and Social Justice. Additionally, the author is currently undertaking an exchange/research traineeship at the Van Vollenhoven Institute for Law, Leiden University. The Author's research focus is related to environmental law issues such as climate law and environmental governance, using a socio-legal or interdisciplinary approach.

Aditya Sewanggara Amatyawangsa Wicaksana, Faculty of Law, Gadjah Mada University, Yogyakarta, Indonesia

Aditya Sewanggara Amatyawangsa Wicaksana was born in Yogyakarta on September 4, 1997. He graduated with a Bachelor of Science in Chemistry from Universitas Islam Indonesia in 2019 and earned a Bachelor of Laws from Universitas Gadjah Mada in 2024 (double degree). Currently, he serves as a teaching assistant and researcher at the Energy Study Center at Universitas Gadjah Mada. Additionally, Aditya offers legal consultancy services, providing legal opinions and assistance. His clients include the Municipal Government of Yogyakarta, the Regional House of Representatives of Yogyakarta (DPRD Kota Yogyakarta), PT Gamareksa Consulting, PT Pertamina, MIND.ID, and several other State-Owned Enterprises (SOE). His areas of expertise encompass corporate law, renewable energy, and mining.
