Abstract


The shift in the role of the Constitutional Court, which has tended tobecome a positive legislator in the last 11 years, began with the existenceof Constitutional Court Decision Number 48/PUU-IX/2011, which, in itsessence, eliminated the limitations on the role of constitutional judges inrendering decisions with a regulatory nature. Consequently, in the last11 years, out of 198 accepted decisions, 107 positive legislative decisionswere identified, and when presented, these positive legislative decisionsconstituted a majority of 54% of the total decisions. The practice ofpositive legislation itself appears to be ineffective, primarily due tothe fact that out of the total 107 decisions, only 26 decisions wereimplemented by the addressees of the decisions. Through normativejuridical research using a statute approach and conceptual approach,this study is focused on understanding why the practice of positivelegislation is not optimal. This is because there is no legal basis, it doesnot fall within the Constitutional Court’s domain to decide cases witha regulatory nature, and there is no obligation for the addressees ofthe decisions to implement positive legislative decisions.

Muhammad Alief Farezi Efendi, Faculty of Law, Universitas Lampung, Lampung, Indonesia

Muhammad Alief Farezi Efendi, S.H. was born on February 26, 2001, in Tanggamus Regency. He completed his primary education at SD Muhammadiyah Gisting, followed by junior high school at SMP N 1 Gisting, and senior high school at SMA N 1 Gadingrejo. Alief pursued his undergraduate degree at the Faculty of Law, University of Lampung and graduated in March 2023. He has completed the Advocate Professional Special Education and currently works as a corporate legal staff in a company located in Jakarta. Alief has also written and submitted several papers to various mass media.

Muhtadi Muhtadi, Faculty of Law, Universitas Lampung, Lampung, Indonesia

Muhtadi has been a permanent lecturer in the Constitutional Law section of the Faculty of Law at Unila since 2008. He completed his undergraduate education at the Faculty of Law, Univ. Tadulako in 1995. Later, he completed his Master of Law at Univ. Andalas Padang in 2008 and obtained a Ph.D. from the S3 Law Study Programme at Unpad Bandung in 2019. Additionally, he holds a certificate in Professional Risk Management (BNSP 2001) and is a certified Non-Judge Mediator (2023).

Ahmad Saleh, Faculty of Law, Universitas Lampung, Lampung, Indonesia

Ahmad Saleh was born on September 25th, 1978 in Bandar Lampung. He is a permanent lecturer in the Constitutional Law section of the Faculty of Law at the University of Lampung. He completed his undergraduate studies at the Faculty of Law, University of Lampung, and his postgraduate studies at the same university. The author is actively involved in research activities and has written several scientific papers for the Faculty of Law at the University of Lampung.
