Abstract


This study aims to determine whether the settlement of criminal cases through restorative justice is an effort to fulfill the constitutional rights of citizens. The method used in this research is normative legal research with a statutory approach and a conceptual approach. The results of the study show that the settlement of cases through restorative justice is an effort to fulfill the constitutional rights of citizens because the principle of resolving cases through restorative justice can be said to be more able to guarantee justice and equality before the law (equality before the law) as regulated in Article 27 paragraph (1), Article 28D paragraph (1) and Article 28I paragraph (2) of the 1945 Constitution of the Republic of Indonesia.

Vinda Agustina, Faculty of Law, University of Lampung, Bandar Lampung, Lampung, Indonesia

Vinda Agustina was born in Desa Negara Tulang Bawang on August 14, 1999. She completed her primary education at SDN 01 Negara Tulang Bawang, her secondary education at SMPN 02 Bunga Mayang, and her higher secondary education at SMAN 02 Kotabumi. Vinda earned her bachelor’s degree from the Faculty of Law at the University of Lampung in 2021. She pursued her master’s degree with a concentration in Constitutional Law at the Faculty of Law, University of Lampung, and graduated in May 2024. Affectionately known as Vinda, she actively collaborated with campus academics in drafting regional regulations from 2020 to 2022. Vinda has also frequently contributed to various national journals.

H. S. Tisnanta, Faculty of Law, University of Lampung, Bandar Lampung, Lampung, Indonesia

H.S Tisnanta was born in Boyolali on September 30, 1961. He has been a lecturer at the Faculty of Law, University of Lampung since 1987. He completed his undergraduate studies at the Faculty of Law, Diponegoro University, graduating in 1985. He earned his Master of Laws from the Faculty of Law, Airlangga University, graduating in 1998, and his Doctorate from the Doctoral Program in Law at Diponegoro University in 2012. He has participated in various training programs and short courses both domestically and internationally, including a sandwich-like program at Flinders University (2009) and a tailor-made program at Leiden University (2010). Additionally, he has been actively involved in various scientific activities, including the ASLI conference (2013, 2014, 2016), the Asian Society of Labour Law (2015, Tokyo, Japan), and the WHCRF (2019, Gwangju, Korea). Currently, he teaches in the Master’s and Doctoral Programs at the Faculty of Law, University of Lampung, and serves as the Head of the Center for Public Policy and Human Rights Studies.

Muhtadi Muhtadi, Faculty of Law, University of Lampung, Bandar Lampung, Lampung, Indonesia

Muhtadi was born in Kabupaten Bekasi on January 24, 1977. He has been a lecturer in the Department of Constitutional Law at the Faculty of Law, University of Lampung since 2008. He completed his undergraduate studies at the Faculty of Law, Tadulako University (Palu, 2001), his Master of Laws at the Faculty of Law, Andalas University (Padang, 2008), and his Doctorate in Law at the Faculty of Law, Padjadjaran University (Bandung, 2019). In addition to teaching in the undergraduate, master’s, and doctoral programs in Law at the Faculty of Law, University of Lampung, he serves as the Chair of the Lampung Regional Board of the Association of Constitutional Court Procedural Law Lecturers (APHAMK), the Head of the Center for Constitutional and Legislative Studies (PuSKaPu) at the Faculty of Law, University of Lampung, and the Head of the Center for Legal Research and Scientific Publications (P3HPI) at the Faculty of Law, University of Lampung, which oversees eight scientific journals and the Justice Publisher within the Faculty of Law.
