Abstract


The Constitutional Court's presence yields positive impacts on constitutional law, yet isn't devoid of controversies, including Judge misconduct, transgression of 'nemo judex idoneus in propria causa' principle, and potential super body transformation. This paper aims to comprehend and analyze constitutional interpretation dominance in assessing laws against the 1945 Constitution through a constitutional dialogue approach. This normative writing employs legal, historical, and conceptual methods. Findings underscore: 1) Demonstrating respect for state institutions, notably the People's Consultative Assembly of Indonesia. 2) Establishing a more democratic system to test the 1945 Constitution's compatibility in the Constitutional Court. 3) Breaking the monopoly of Constitutional Court-centric constitutional interpretation. 4) Reviving 'nemo judex idoneus in propria causa' principle is pivotal due to extensive testing of Constitutional Court Law, addressing concerns about verdict impartiality.

Ahmad Ahmad, Faculty of Law, Gorontalo State University, Indonesia

Ahmad's primary to upper-middle education was completed in Tolitoli Regency. He attended elementary school at SDN 01 Lanang Lampasio Village, middle school at SMPN 1 Lampasio, and upper-middle school at SMAN 2 Tolitoli. He completed his undergraduate level at the Faculty of Law, Gorontalo State University, in 2018. He continued his S2 studies with a concentration in constitutional law at the Gorontalo State University postgraduate program and graduated in 2021. Currently, Ahmad, as he is familiarly called, is a lecturer at the Faculty of Law, Gorontalo State University. He has often written in various national and international journals, local and national mass media, and has spoken at several local and national forums. Some of the books he has published include: "Penataan Wewenang dan Tugas MPR" (Badan Pengkajian MPR, Jakarta, 2019), "Urgensi Bentuk Hukum Dan Penegakannya, Serta Substansi Pokok-Pokok Haluan Negara" (Badan Pengkajian MPR, Jakarta, 2020), "Hukum Konstitusi (Menyongsong Fajar Perubahan Konstitusi Indonesia melalui Pelibatan Mahkamah Konstitusi)" (UII Press, Yogyakarta; 2020), "Kajian Terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 Dan Pelaksanaannya" (Badan Pengkajian MPR, Jakarta, 2021), and "Constitutional Dialogue (Menguatkan Interaksi Menekan Dominasi: Konvergensi Terhadap Pengujian Norma di Mahkamah Konstitusi)" (UII Press, Yogyakarta; 2022).

Fence M. Wantu, Faculty of Law, Gorontalo State University, Indonesia

Fence M. Wantu's educational background is as follows: He attended SDN 1 Bua in the Batudaa District, then continued his education at Batudaa State Junior High School. Later, he graduated from SMA Negeri 3 Gorontalo City. In 1997, he earned a Bachelor of Law degree from Samratulangi University in Manado. Subsequently, he pursued a Master of Law degree at Gadjah Mada University (UGM) in Yogyakarta, completing it in 2005, with the Postgraduate Education Fees (BPPS) sponsored by DIKTI. In 2011, he obtained his Doctor of Law degree from Gadjah Mada University (UGM) in Yogyakarta, also supported by DIKTI. Currently, Mr. Wantu serves as a supervisor for courses in Procedural Law, Legal Philosophy, and Legal Research Methods. He is actively engaged in academic writing, contributing to various journals and media outlets, where he conducts research on legal issues. In addition to his academic pursuits, he frequently provides legal counseling to both the community and schools. He has also been involved as the drafter of various Regional Regulations in Gorontalo Province.

Dian Ekawaty Ismail, Faculty of Law, Gorontalo State University, Indonesia

Dian Ekawaty Ismail graduated with a Bachelor of Law from Sam Ratulangi University in Manado in 1997, a Master of Law from Hasanuddin University in Makassar in 2006, and a Doctor of Law from PDIH Sultan Agung Islamic University in Semarang in 2018. She is currently working as a lecturer in Law at S1 and Master of Law (S2) at Gorontalo State University.
